How long does it take from when they first contact you to let’s say a resolution of the case, whether it’s a settlement or if they have to go to trial? Is New York as, not behind times, but as backlogged with civil cases as the rest of the states?

Steven Gacovino – Personal Injury Attorney – Suffolk County, NY

I don’t have a lot to compare it to because I really only practice local personal injury law in New York, so I’m not sure what’s happening in other jurisdictions. In New York, it’s not necessarily a fast process. Different counties move at different speeds and cases move at different speeds for various reasons.

Some cases are just much more complicated. Some have multiple parties. Sometimes things happen like a party may pass away or a party may file bankruptcy. These can cause delays in litigation, but if I was to give you an average estimated time from beginning to end, I’d say you could expect between 12 and 24 months is typically where most cases wind up resolving.
